Public Offer for entering into a distance retail sale agreement This document constitutes an offer by Individual Entrepreneur Kristina Yuryevna Akkerman, OGRNIP 325530000027941, INN 532124515496 (hereinafter referred to as the “Seller”), to enter into a distance retail sale agreement with an individual (hereinafter referred to as the “Buyer”) on the terms set out below. 1. General Provisions 1.1. The Seller undertakes to transfer KINOKO clothing, accessories or other goods (hereinafter referred to as the “Goods”) to the Buyer, and the Buyer undertakes to accept and pay for the Goods. 1.2. The assortment is presented in the catalogue on this website and in the official KINOKO Telegram channel: https://t.me/kinokomerch. The order and its specifications are agreed with the manager: https://t.me/kinoko_adm. 1.3. Before payment, the correspondence or payment link records the name of the Goods, quantity, size, standard or agreed colour, price of the Goods, delivery method and cost, payment procedure, a specific final deadline for transferring the Goods to the Buyer and, where applicable, the individual specifications of the order. 1.4. The retail sale agreement is deemed concluded in the cases and from the moment prescribed by the laws of the Russian Federation, including from the moment the Seller receives a message from the Buyer expressing the intention to enter into the agreement or from the moment a document confirming payment for the Goods is issued or sent. Payment through the payment link provided by the Seller confirms the Buyer’s acceptance of the terms of this Offer and the agreed terms of the order. If the parties agree in writing on payment by instalments, the schedule for subsequent payments and the commencement of production are recorded in the correspondence. 1.5. The version of the Offer in effect at the time the agreement is concluded applies to the order. The price of Goods that have already been paid for may not be changed. 2. Ordering and Payment 2.1. The Buyer selects the Goods in the catalogue and contacts the manager. The manager checks the availability of the base item, agrees the order specifications and sends the Buyer an individual payment link. 2.2. Payment may be made using the methods specified in the payment link. The price of the same Goods does not vary depending on the selected payment method, including payment by instalments. 2.3. The Buyer’s payment obligation is deemed fulfilled once the funds have been credited to the Seller. 2.4. After the order has been placed, the Seller sends a confirmation containing the order number or another order identifier and the agreed essential terms: the Goods, quantity, specifications, price, delivery method and cost, the final deadline for transferring the Goods to the Buyer and the payment procedure. After payment, the Buyer receives a fiscal receipt. 3. Production, Delivery and Transfer 3.1. As a general rule, production and transfer of the order to the delivery service takes up to 20 calendar days from the date of payment. Before payment, the Seller informs the Buyer of a specific final deadline for transferring the Goods to the Buyer, taking into account production and the selected delivery method, and records it in the order confirmation. After payment, this deadline may be changed only by agreement between the parties. The deadline for ready-made Goods is confirmed separately. 3.2. The delivery service’s transportation time is not included in the production period. After the order has been transferred to the carrier, the Seller provides the Buyer with tracking information if such information is provided by the carrier. 3.3. Delivery is paid for separately by the Buyer. The delivery method and cost are agreed before payment and depend on the destination, shipment parameters and the carrier’s applicable rate. 3.4. Available delivery methods may include CDEK, Russian Post, Ozon and Yandex pickup points, courier handover near Kurskaya metro station, as well as international delivery to destinations where it is technically and logistically feasible. 4. Cancellation, Returns and Defective Goods 4.1. The Buyer may cancel the Goods at any time before they are transferred to the Buyer and, after transfer, subject to the conditions established by the laws of the Russian Federation and the “Returns” section on this page. 4.2. KINOKO voluntarily provides a period of 14 calendar days from the date of receipt for returning Goods of proper quality, provided that their appearance and consumer properties have been preserved. This provision does not limit any rights granted by law. 4.3. If a defect is discovered, the Buyer may make any claim provided for by consumer protection legislation. Photos or videos may assist with the initial assessment, but their absence does not deprive the Buyer of the right to submit a claim and provide the Goods for a quality inspection. 5. Liability and Disputes 5.1. The parties will seek to resolve disagreements through negotiation. A claim may be sent to cool.kinoko@yandex.ru or to the manager at https://t.me/kinoko_adm. 5.2. If a dispute cannot be resolved, it will be considered in accordance with the procedure and jurisdiction prescribed by the laws of the Russian Federation. 1. Production and Dispatch Time As a general rule, we produce and transfer an order to the delivery service within 20 calendar days from the date of payment. The exact cost depends on the destination, weight, dimensions and selected rate. The manager informs the Buyer of the cost before payment for the order. 3. Tracking and Receipt After the parcel has been transferred to the carrier, we provide tracking information if such information is provided by the delivery service. 1. Goods of Proper Quality The Buyer may cancel the Goods at any time before they are transferred to the Buyer. After receipt, KINOKO provides 14 calendar days for the return of Goods of proper quality. A return is possible if the appearance and consumer properties of the Goods have been preserved and there are no signs of wear, washing, staining, odours or damage. 2. How to Make a Return Contact the manager at https://t.me/kinoko_adm or email cool.kinoko@yandex.ru, specifying the order number and the Goods you wish to return. We will agree on the shipping method and provide the return address. The Buyer bears the costs and the risk of damage to Goods of proper quality during return transportation. The Buyer may return the Goods remotely through a carrier or postal service using a method that allows their condition to be inspected upon receipt. We will provide the current return address and available options in our response and, where necessary, agree on another reasonable method. Funds are refunded no later than 10 calendar days from the date the return request is made. The Seller may deduct only the actual cost incurred by the Seller in transporting the returned Goods from the Buyer if such return transportation was paid for by the Seller. If the Buyer pays for the return delivery independently, the price of the Goods is refunded in full. The actual time required for the funds to be credited after the refund is issued may depend on the bank. 3. Defective Goods If a defect is discovered, the Buyer may exercise the rights provided for by Articles 18–24 of the Law of the Russian Federation “On Consumer Rights Protection” within the periods established by law. Photos or videos may assist with the initial assessment but are not a mandatory condition for submitting a claim. If there is a dispute regarding the cause of the defect, the Seller conducts a quality inspection and, where required by law, an expert examination at its own expense. The Buyer has the right to participate in the quality inspection and challenge the expert opinion. The Seller bears the cost of returning Goods with a confirmed defect and the cost of delivering replacement Goods. The time limits for refunds, replacements and satisfaction of other claims are determined by law. 4. Incorrect Order or Missing Item If you receive the wrong item, size or colour, or if an item is missing from your order, please contact us. Purposes: consultation, conclusion and performance of the agreement, payment, issuance of a receipt, delivery, return, handling of inquiries and protection of the parties’ rights. 2.4. Order recipients. If the recipient differs from the Buyer, the following data may be processed: surname, first name, patronymic, telephone number, address, postal code, pickup point and other information necessary for delivery. Purpose: delivery of the order. 2.5. The Operator does not process special categories of personal data or biometric personal data. Data is not used for advertising mailings and is not transferred to third parties for their own independent advertising purposes. 2.6. KINOKO does not transmit to Yandex Metrica a person’s full name, telephone number, email address, delivery address, Telegram username, correspondence, order number or payment information. 3. Legal Grounds 3.1. The legal grounds for processing include entering into and performing an agreement at the initiative of the data subject, complying with the Operator’s statutory obligations, exercising rights and legitimate interests provided that the rights of the data subject are not violated, as well as consent where such consent is required. 3.2. Optional web analytics is carried out only on the basis of the user’s separate, specific, informed and unambiguous consent. Until the user selects “Allow analytics”, the Yandex Metrica and Webvisor code is not loaded. 3.3. To place an order, the user must provide information without which it is impossible to agree, pay for or deliver the Goods. Refusal to provide such information may make performance of the order impossible. Refusal of web analytics does not restrict access to the catalogue or the website’s core functions. 4. Data Processing Operations, Methods and Parties Involved 4.1. Depending on the purpose, the Operator may carry out collection, recording, systematisation, accumulation, storage, updating, retrieval, use, transfer to the extent necessary, blocking, deletion and destruction of data, with or without the use of automated means. 4.2. Access is granted only to the Operator, the manager and persons who require such access to fulfil the order, ensure the operation of the website or comply with legal requirements. 4.3. To the extent necessary, order data may be transferred to payment organisations and banks, instalment payment services, delivery services and pickup points, fiscal receipt service providers, messenger services, hosting and technical infrastructure providers, as well as order accounting services. 4.4. Yandex Metrica and its Webvisor feature are used for optional web analytics. Visit data is automatically transferred to YANDEX LLC (16 Leo Tolstoy Street, Moscow, Russia), which participates in the processing and provides the service under the terms published at yandex.ru/legal/metrica_termsofuse. Yandex’s processing of data is also described in its Privacy Policy. 4.5. Webvisor may record the user’s actions during a website visit. Recording of the contents of input fields is disabled. 4.6. If processing involves cross-border transfer, the Operator complies with the requirements established by law before such transfer begins. When collecting data of Russian citizens via the Internet, the Operator complies with the applicable requirements regarding the use of databases located within the Russian Federation. 5. Retention Periods 5.1. Order data and correspondence are processed during performance of the agreement and consideration of inquiries and, thereafter, for periods necessary to comply with statutory obligations and protect the parties’ rights. Once the purposes of processing have been achieved, the data is deleted or anonymised unless continued retention is required by law. 5.2. Accounting, tax and fiscal documents are retained for the periods prescribed by law. 5.3. Retention periods for technical logs are determined by hosting and technical infrastructure providers, taking into account the purposes of ensuring website operation and security and the requirements of law. 5.4. Consent to web analytics remains valid until it is withdrawn by the user, the relevant purpose of processing ceases to exist or the terms of the consent materially change. Specific Yandex Metrica cookies and online identifiers have retention periods determined by the service settings and Yandex documentation. KINOKO does not establish a separate arbitrary retention period for them. 5.5. After consent is withdrawn, KINOKO stops subsequently launching analytics for that browser. Withdrawal does not automatically result in deletion of information that was previously processed lawfully; any further processing and deletion is carried out where lawful grounds exist and in accordance with applicable law and the terms of the service. 6. Data Protection and Data Subject Rights 6.1. The Operator takes the necessary legal, organisational and technical measures to protect data against unlawful access, alteration, disclosure, blocking and destruction. 6.2. The data subject has the right to request information about processing, request correction, blocking or destruction of data, withdraw consent and challenge the Operator’s actions. 6.3. Consent to web analytics may be changed or withdrawn using the “Analytics settings” link in the website footer. In addition, the user may prevent the collection of website visit data and session recording by using the official browser extension “Yandex Metrica Blocker”. The current version is published on the “Legal Documents” page of the KINOKO website. A new version applies from the moment it is published and does not have retroactive effect. 7.2.
